An Australian SMSF must be established with a trust deed that is compliant with Australian superannuation legislation.

The deed in conjunction with superannuation legislation will govern the way you behave as an SMSF trustee.

Trust deeds will generally detail:

  • How the fund needs to operate
  • Who can be a member
  • How key benefits such as pensions can be paid
  • The manner in which death benefit payments can be made

Given your fund’s trust deed needs to remain in line with legislation we recommend it is upgraded if and when there are significant changes to superannuation that will impact on your fund.

A key risk as an SMSF trustee, is doing something that is not permitted by the trust deed such as paying a type of pension to a member that is not allowed.
